Terms of Service

By engaging the services of Luxury Lifestyles Patio and Pool for construction-related projects, you (“Client”) agree to be bound by these Construction Terms of Service (“Terms”). If you do not agree to these Terms, please do not engage our services. These Terms govern the construction services provided by Luxury Lifestyles Patio and Pool, a luxury outdoor construction company (hereinafter referred to as “Contractor”).

Before commencing construction, a separate project agreement will be established between the Client and the Contractor, specifying project details, scope, timeline, costs, and any other relevant terms. These Terms supplement and are incorporated into the project agreement.

Payment terms will be outlined in the project agreement. Typically, payments are due in installments, with an initial deposit required before the start of construction. The Client agrees to make timely payments as specified in the project agreement.

The scope of work for the construction project will be detailed in the project agreement. Any changes or modifications to the scope must be documented in writing and agreed upon by both parties.

The Contractor will obtain the necessary permits and approvals required for the construction project, as specified in the project agreement. The Client agrees to cooperate with the Contractor in obtaining any required permissions.

The project agreement will include an estimated timeline for the completion of the construction project. Delays may occur due to unforeseen circumstances, including weather, permit delays, or unforeseen site conditions. The Client will be notified of any significant delays.

The Client agrees to provide access to the construction site and ensure a safe working environment for the Contractor and their team.

Any changes or additions to the project scope must be documented in writing and agreed upon by both parties. Additional costs resulting from changes will be outlined in a change order and must be approved by the Client.

The Contractor will provide warranties as specified in the project agreement for the materials and workmanship used in the construction project.

The Contractor will maintain liability insurance coverage during the construction project. The Client is responsible for maintaining their own insurance coverage for the property.

Either party may terminate the project agreement with written notice under the conditions outlined in the project agreement.

Any disputes arising from the construction project will be resolved in accordance with the dispute resolution mechanisms outlined in the project agreement.

The Contractor is not liable for any damages or losses resulting from factors beyond their control, including but not limited to acts of nature, vandalism, or theft.

These Construction Terms of Service and any project agreements are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Harris County.
